Plant protection products in another area of application; application for individual authorization for use

Procedure details

Plant protection products may only be used if

  • the products are authorized
  • the authorization is not suspended and only
  • in the respective valid areas of application specified in the authorization (crop x harmful organism),
  • in accordance with the valid conditions of use specified in the authorization.

The legal requirements for the use of plant protection products have led to indication gaps in numerous horticultural crops, but also in special agricultural crops. In order to close the indication gaps, there is the possibility of an authorization according to § 22 para. 2 of the Plant Protection Act (PflSchG).

With an individual authorization, authorized plant protection products can be used in an area of application other than that specified in the authorization.

Individual professional users (e.g. farmers, gardeners) or legal entities (e.g. producer associations, producer rings) are eligible to apply.

Individual approval is subject to strict regulations. These include

  • Use on plants that are only cultivated on a small scale or pests that only cause significant damage in certain areas.
  • Food from these plants contributes only marginally to the daily diet.
  • The expected residues of the plant protection product do not exceed the maximum residue levels.
  • For residue-relevant crops, data on the degradation behavior of the plant protection product applied for must be available.
  • The intended use must correspond to an area of application already specified in the authorization.

  • You must submit the following documents:
    • completed application for approval in individual cases or application for extension of the approval period
    • for collective applications: Address list of users
    • for residue-relevant crops: results of residue tests

The approval in individual cases or the application for an extension of the approval period must be submitted to the Bavarian State Institute for Agriculture, Institute for Plant Protection.

The application documents can be submitted by e-mail or in writing.

Once the application has been successfully reviewed, approval will be granted until the end of the approval of the plant protection product applied for or for a maximum of three years.

  • Approval of individual application: 30 EUR
  • Approval of collective application: 30 EUR + 15 EUR per participant, maximum 250 EUR
  • Extension for individual or collective application: 20 EUR

All documents required for approval must be submitted at least three weeks before the planned use of the plant protection product.

If the Bavarian State Institute for Agriculture has received all the necessary documents, the application can be processed within three weeks.
