Driving aptitude register; application for deletion of an entry

In special exceptional cases to avoid unjustified hardship, it may be ordered that entries in the driving aptitude register (points) are deleted.

The competent government can order the deletion of entries in the driving aptitude register in accordance with Section 29 Para. 3 No. 2 of the Road Traffic Act (StVG) for entries that are not to be included in the Federal Central Criminal Register - irrespective of otherwise applicable deletion periods and prohibitions - if this is necessary to avoid unjustified hardship and public interests are not jeopardized.

In this respect, premature erasure can only be considered in exceptional cases, for example if the underlying decision is materially incorrect and the person concerned has allowed it to become legally binding through no fault of their own.

Early repayment can be ordered ex officio or upon application.

There is no legal entitlement to the order. It is a discretionary decision.

The prerequisite is that the underlying decision under fine law or criminal law is materially incorrect and that the person concerned has allowed it to become legally binding through no fault of their own.
