The overall responsibility for safety and order in an operation that is subject to mining law lies initially with the mining company, represented by the company's board of directors or, in the case of legal entities and commercial partnerships, the persons authorized to represent them by law, articles of association or partnership agreement.
Responsibility for the management and supervision of individual parts of the company can be delegated to other supervisors (responsible persons). The application to nominate a person to delegate responsibility (appointment) must be made in writing.
The tasks and powers must be described precisely in the appointment; the powers must correspond to the tasks. Internal company instructions must ensure that the responsible persons can fulfill their tasks and exercise their powers.
Prerequisite for appointment as a responsible person:
You must notify the competent authority of the appointment of a responsible person.
