After unsuccessful measures to maintain fitness for duty, an application can be made to examine the fitness for duty of a civil servant teacher at primary and secondary schools, special schools, schools for the sick or vocational schools (excluding FOS/BOS).
This form can be submitted electronically without signature (e.g. via a secure contact form or by e-mail) or in paper form to the responsible authority.
Civil servants for life are to be retired if they are permanently unable to perform their official duties (unfit for duty) due to their physical condition or for health reasons. In order to clarify whether one of these conditions applies, the competent government is tasked with obtaining an official medical opinion.
If an application for retirement is submitted in the cases of Section 26 (1) of the Civil Servants Status Act, the incapacity for service is determined by the immediate superior declaring, on the basis of an official medical report on the state of health, that he or she considers the civil servant to be permanently incapable of fulfilling his or her official duties at his or her due discretion.
The application for a review of fitness for service in the case of retirement transfers and limited fitness for service for teachers at elementary school, secondary schools, special schools, schools for the sick and vocational schools must be submitted to the responsible government.
