Procedure details

According to the Bavarian Water Act, wastewater disposal is a mandatory task of the municipalities and cities and is carried out by them within their own sphere of influence. The municipalities and cities (or municipal wastewater associations) build and operate sewer networks (for wastewater collection and discharge) and wastewater treatment plants (for wastewater treatment).

Wastewater may only be discharged into bodies of water if its quality meets certain minimum requirements, which are laid down in the Federal Water Act and specified in the Wastewater Ordinance.

To ensure that the municipalities and cities can collect the wastewater and comply with the requirements, they regulate the scope of the municipal area to be sewered as well as the requirements for the type and quality of the wastewater to be discharged into the sewer system by households and commercial enterprises through the municipal drainage bylaws. The statutes on contributions and charges regulate the financing of the wastewater facilities via (one-off) contributions and (ongoing) charges. In those areas of the municipal area where no public sewer system is installed, the proper disposal of wastewater is the responsibility of the property owners and is usually carried out via small wastewater treatment plants.

    If the objection has no suspensive effect, an application for suspension of enforcement can be made to the original authority or the objection authority in accordance with Section 80 (4) VwGO. Instead, an application for an order or restoration of the suspensive effect of the objection can be made to the competent Bavarian Administrative Court in accordance with Section 80 (5) VwGO.

    Please note: If it concerns the demand for public charges and costs (§ 80 Para. 2 Sentence 1 No. 1 VwGO), an application to the court is generally only admissible if the authority has previously rejected an application for suspension of enforcement (§ 80 Para. 6 VwGO).
