Procedure details

Benefits for farm and household help from the Agricultural Pension Fund (LAK) may be available

  • if you are absent
    • as a result of incapacity for work,
    • as a result of medical prevention or rehabilitation measures or
    • due to pregnancy and maternity leave.
  • after the death of the farmer.

The LAK ensures that your farm or household continues to operate and that your income base is maintained. The benefits for farm and household help mainly cover work that cannot be postponed.

The LAK either provides a qualified employee for this purpose, which is known as a "provided employee". Or you can find a replacement yourself.

The provided workers can be SVLFG employees or employees of other organizations, for example a machinery ring or a company support service.

If you procure a replacement yourself, we will reimburse the costs for this to an appropriate amount; maximum amounts apply. Please note that no deployment costs can be covered for relatives and in-laws up to the second degree. The replacement employee must also be external to the company, i.e. they must not otherwise work in the company or in the household or help out significantly.

In the event of incapacity for work, benefits for business and household help are possible for a maximum of 4 weeks, in the case of inpatient treatment for a maximum of 13 weeks. An extension is possible under certain conditions.

After the death of the farmer, farm and household help is possible for up to 12 months within 2 years of the date of death.

The LAK provides benefits for business and household help if

  • your company reaches the minimum size and
  • you are insured as
    • agricultural entrepreneur or agricultural entrepreneur or
    • a registered life partner.

You must also be absent due to

  • medically certified incapacity for work,
  • a medical rehabilitation measure by the old-age insurance fund or German Pension Insurance or during a preventive/rehabilitation benefit from your health insurance fund or
  • pregnancy and maternity leave.

In the event of the farmer's death and similarly in the event of the death of other persons, in particular a single farmer:

  • The business continues to be managed subject to compulsory insurance.

Benefits for farm and household help must be necessary to maintain the agricultural business or household. This is important when deciding whether and, if so, to what extent you will receive farm and household help.

Depending on the reason for use, the permanent employment of employees or family members working with you may lead to the exclusion of the benefit. The LAK will check this on a case-by-case basis.

Activities in non-agricultural parts of the company (ancillary companies) are excluded from farm and household help.

  • Required Documents

You can apply for LAK company and household assistance benefits by post, fax, e-mail or online.

Application by post, fax or e-mail:

  • The LAK provides a form. Download it from the website of the Social Insurance for Agriculture, Forestry and Horticulture (SVLFG).

    • If the benefit is to be paid due to incapacity for work, a medical certificate is required. The doctor can use the forms available in the practice for this. However, the LAK also provides its own form.
    • Enclose proof of rehabilitation measures, if provided by institutions other than the SVLFG, of the start of maternity leave or, in the event of death, a death certificate.
  • Then submit the documents to the LAK.

No costs are incurred.

If LAK provides a qualified replacement, it will cover the costs in full.

If a replacement cannot be provided, LAK will reimburse the costs of an external replacement procured by you in an appropriate amount. The actual cash benefits incurred will be taken into account, in particular the remuneration for the work and travel costs. Benefits in kind, on the other hand, are not taken into account. Maximum amounts apply to the reimbursement amounts. The following are considered reasonable: proven expenses up to a maximum daily amount of 2.95 percent of the applicable monthly reference value, rounded up or down to the nearest even euro amount.

There is a co-payment for business and home help services provided to surviving dependants as a result of a death. The amount of the co-payment is determined on a case-by-case basis. In all other cases there is no excess.

There are no application deadlines.

Benefits for business and household help are possible from the day of application at the earliest.

There are no requirements with regard to processing deadlines. However, decisions on benefits for business and household assistance are generally always required very promptly; this is taken into account by the LAK accordingly, so that decisions are generally made within a few days, unless there are certain reasons that extend the processing time.
