Procedure details

A partition auction is the forced settlement of an existing community in a property (e.g. fractional communities or communities of heirs).

The aim of a partition auction is to "convert" the property into money. A decision on how these proceeds are subsequently distributed to the parties involved is not made in this procedure.

A partition auction is to be held in order to terminate a community in a property.

  • Documents to be attached:

    • If available: Expert opinion on the value of the property
Such an expert opinion may possibly be utilized in the course of the court proceedings.
    • if a community of heirs to a property is involved: Evidence of succession

You must always apply for a partition auction at the local court in whose district the property is located. Compulsory auction cases are not processed at every local court. You will be shown the local court responsible once you have selected the location of the property.

The applicant must bear the costs of the order (EUR 110 + EUR 3.50 service costs per co-owner). These are due upon decision on the application.

All applicants are also liable for all further costs incurred in the proceedings. The amount of these costs depends on the value of the property and the number of appointments to be made.
