Procedure details

If a mining project meets one of the criteria specified in Section 1 of the Ordinance on the Environmental Impact of Mining Projects, a framework operating plan must be requested in accordance with Section 52 (2a) in conjunction with Section 57a of the Federal Mining Act and a planning approval procedure must be carried out for its approval.

For mining projects in the administrative districts of Upper Franconia, Middle Franconia, Lower Franconia and Upper Palatinate, the government of Upper Franconia - Bergamt Nordbayern - is the responsible hearing authority and plan approval authority. For mining projects in the administrative districts of Upper Bavaria, Lower Bavaria and Swabia, the government of Upper Bavaria - Mining Office of Southern Bavaria - is the responsible consultation authority and plan approval authority.

An environmental impact assessment must be carried out as part of a planning approval procedure under mining law. This comprises the determination, description and assessment of the direct and indirect effects of a project on

  • People, including human health, animals, plants and biodiversity,
  • soil, water, land, air, climate and landscape,
  • cultural assets and other material assets and
  • the interaction between the aforementioned protected assets.

A key feature of the planning approval procedure is the involvement of the public in the procedure.

In the context of operating plan procedures with formal public participation, the operating plan documents on display can be viewed in electronic form (see "Further links"). In addition to being made available on the Internet, the documents are also made available in paper form during office hours in the municipalities concerned and at the responsible government offices. The documents generally remain available until the end of the consultation procedure.

Please note that objections are only admissible within the display and objection period in accordance with the announcement of the mining authority and that objections cannot be raised by e-mail.

After the objection period has expired, a so-called hearing will take place. At this hearing, the hearing authority discusses the objections to the plan raised in good time and the comments of the authorities on the plan with the project sponsor, the authorities and those who have raised objections.
