Procedure details

Civil servants or other employees who were exempt from pension insurance due to guaranteed pension entitlements must be re-insured in the statutory pension insurance scheme for the period of employment exempt from insurance if they leave employment exempt from pension insurance without a claim or entitlement to a pension. Deviations may apply in the event of a career change to a member state of the European Union (cf. Art. 99a BayBeamtVG).

Subsequent insurance is postponed if employment without pension insurance is taken up again immediately or presumably within two years of leaving and the subsequent insurance period is taken into account in the pension entitlement from the other employment.

The contributions to be paid subsequently are to be borne solely by the previous employer. In principle, they must be paid directly to the responsible pension insurance institution.

Members of occupational pension schemes have the option of applying for subsequent insurance in the occupational pension scheme within one year of leaving employment without insurance.

As a rule, the State Finance Office is responsible for carrying out the subsequent insurance or issuing a deferment certificate. In special cases, the higher regional courts and the governments may also be responsible. Those affected will be contacted by the responsible office.

In order to carry out the supplementary insurance or issue a deferral certificate, the forms for supplementary insurance in the pension insurance and for checking the requirements for deferral of supplementary insurance in the statutory pension insurance (see "Forms") must be completed and sent to the employer.

No application is required. The employer takes action on its own initiative.

According to the provisions of pension law, a decision must be made immediately at the time of leaving employment without pension insurance as to whether the Free State of Bavaria must pay pension insurance contributions by way of subsequent insurance to the responsible pension insurance institution or to an occupational pension scheme or whether subsequent insurance can be postponed because the intention is to take up employment without insurance again.

It is therefore important to answer the questions in the questionnaires quickly. The more accurate the information is, the faster the subsequent insurance can be processed or the subsequent insurance can be postponed.
