The right to remuneration is one of the traditional principles of the civil service in accordance with Article 33 (5) of the German Basic Law. The employer undertakes to provide civil servants, civil servants, judges and their families with appropriate remuneration (the so-called alimentation principle).

The entitlement to salary arises on the day on which the appointment, transfer, acceptance or transfer into the service of the Free State of Bavaria takes place.

Salaries are governed by the Bavarian Salaries Act (BayBesG), which applies not only to civil servants and judges of the Free State of Bavaria but also to civil servants of municipalities, associations of municipalities and other institutions, foundations and public corporations under the supervision of the state.

The salary is made up of basic and additional payments.

Basic pay includes, for example, the basic salary, the local and family allowance and official allowances. Fringe benefits include, for example, allowances, the annual special payment and capital-forming benefits.

The amount of the salary depends, among other things, on the office held, the grade, the marital status and the main place of residence.

The salary offices of the departments of the State Office of Finance are responsible for determining, ordering and settling the salaries of civil servants and judges of the Free State of Bavaria.

In order to commence payment of salary, the necessary information is provided to the State Finance Office electronically or in paper form by the department managing the personnel. This also applies to subsequent changes in the amount of salary, such as a reduction in salary entitlement due to part-time employment.

Some information and changes must be communicated directly to the State Finance Office by the recipient of the salary. This includes, for example, a change of bank details or a change of main residence.

Salary recipients are informed of the amount of their salary by means of a salary notification. This is issued whenever there are changes to the amount of the salary. Civil servants and judges are obliged to inform the State Finance Office immediately of any inaccuracies in the salary notification.
