At the request of parents or legal guardians, elementary school or secondary schools that are not members of a secondary school network may be permitted to attend another elementary school or secondary school with a different district for compelling personal reasons.
Compulsory schooling must generally be completed at the local elementary school and secondary school (Sprengelschulen). At the request of parents/guardians, elementary school or independent secondary schools (which are not members of a secondary school group) may be permitted to attend another elementary school or secondary school with a different district for compelling personal reasons.
In addition to the guest school relationship for compelling personal reasons discussed here, a guest school relationship can also arise through assignment by the state education authority in accordance with Art. 43 Para. 2 of the Bavarian Education and Teaching Act (BayEUG).
If there are several secondary schools within a district (secondary school network), no guest school relationship can arise as a result of the common district within the network, but only if attendance at a secondary school outside the network with another district is requested. Parents/guardians and pupils of full age have the right to choose a school within the network. The freedom of choice may be restricted by provisions of the network agreement or the school authority or if the number of applications exceeds the number of places at a school or if the government decides that this is necessary in the interests of a balanced composition of classes; however, the restrictions do not apply if there are compelling personal reasons to attend another school in the network.
The decision is made by the municipality in which the pupils have their habitual residence in agreement with the host school authority after consultation with the schools concerned. With the approval of the guest school attendance, the entitlement to transportation no longer applies. These costs are then to be borne by the parents/guardians.
Guest school relationships can be approved by the decision-makers under the conditions of Art. 43 BayEUG. With regard to the period for which a guest school relationship is granted, the decision-makers have discretionary powers. From an educational point of view, a guest school relationship should be granted for at least one school year.
The completed application form can be submitted either to the responsible school, the host school or the municipality/city. After the decision on the guest school application, the applicant will receive a guest school notification.
After the expiry of the decided period of exemption from the obligation to attend a school in the district, the host school relationship may have to be applied for again.
A basic district and subject district are formed for each vocational school.
State special schools and schools for the sick are established and dissolved by statutory order. The school districts are also defined here.
If a pupil does not wish to attend the Sprengel vocational school responsible for him/her but another vocational school, a guest school relationship must be applied for. In the absence of approval from one of the authorities involved, the government will decide.
