Procedure details

The purpose of state planning statements in accordance with Art. 27 of the Bavarian State Planning Act (BayLplG) is to determine whether a plan or measure complies with the relevant spatial planning requirements without conducting a formal spatial planning procedure.

They are issued to public planning authorities by the responsible higher state planning authority at the governments.

In terms of numbers, the most important case of application are the state planning statements as public agencies involved in the preparation of urban land-use plans in accordance with Section 4 of the Federal Building Code (BauGB). In addition, the higher state planning authority also comments on specialist planning approval procedures such as planning approval procedures, the designation of water or nature conservation areas or immission control approval procedures.
