With the unchanged adoption of the referendum "Biodiversity & Natural Beauty in Bavaria", the ban on rolling grassland after March 15 has applied to agricultural use since 2020.

This legal ban on rolling can restrict agricultural use to varying degrees depending on local weather and soil conditions. The start of vegetation and the trafficability of the soil vary greatly from region to region in Bavaria. Where grassland cannot be driven on and rolled before March 15 due to weather and soil conditions, the ban means a considerable disruption to farmers' operations. For these areas, the agricultural use of the land as a whole is regularly called into question by the ban.

As a result, without a deviating regulation to avoid hardship cases, the conditions for granting an exemption may be met in a considerable number of cases in many areas.

Under certain conditions, the district governments may, by general order, permit the rolling of grassland after March 15 of the respective calendar year for the area of entire districts or independent cities or for certain defined parts thereof.

The general order may be issued as long as, according to current weather forecasts, the areas concerned are predominantly

  1. the grassland used for agricultural purposes cannot be rolled before 15 March if good agricultural practice is observed, in particular due to excessive soil moisture or snow-covered areas, and
  2. the main breeding season for meadow breeders has not yet begun in the meadow breeding areas.

The general ruling will specify a date from which rolling is prohibited in the relevant calendar year and area.

Public announcement

The general ruling on the rolling of grassland areas must be published locally at the earliest possible date. This general ruling by the government is published in the regular official gazette or the special official gazette before March 15 of the respective calendar year.

The district governments are responsible for issuing a general ruling on the rolling of grassland. Local jurisdiction is determined by the Bavarian Administrative Procedure Act.

The government receives a technical assessment from the Bavarian State Institute for Agriculture (LfL) on the basis of data from the German Meteorological Service (DWD) as to when the soil can be expected to be passable.

The government also receives data from the Bavarian State Office for the Environment (LfU) on the expected start of breeding of meadow breeders in the meadow breeding areas.

On the basis of the opinions of the State Institute for Agriculture and the State Office for the Environment, the government decides whether to issue a general decree permitting the rolling of grassland areas after March 15 of the respective calendar year.
