Procedure details

The main focus of the work of the State Attorneys' Office is on

  1. Advice / cooperation in specific disputes

The state attorneys exchange information with the employees of the authorities involved on the respective factual and legal problems on an ad hoc basis and are therefore available to provide advice beyond the representation in court.

  2. Case law service - directly and on the Internet, also via Twitter

New decisions of the Bavarian Administrative Court can be requested in anonymized form by authorities and public officials directly from the State Prosecutor's Office immediately after they are issued (transmission only electronically).

The latest decisions, in particular of the Administrative Court, the Federal Administrative Court or the European Court of Justice, are posted on the website of the State Prosecutor's Office ("Important new decisions") as a permanent up-to-date case law service. If no guiding principles are available, orientation sentences are created and, if necessary, further information on the consequences is provided.

You can also follow this information service on Twitter (@LA_Bayern). You will be notified of the publication of an "Important new decision" via Twitter and can access it via a link.

  3. Conceptual implementation work

In its representation work in the second and third instance, the State Attorney's Office has to penetrate the respective subject matter of the dispute, filter out and assess the technical and legal-dogmatic consequences. It is therefore not only a procedural authority, but necessarily a part of the administration that thinks and acts together. It discusses the consequences with the responsible authorities, in particular the ministries, which then control the administrative implementation accordingly.
