The provision or offering of reserved activities for remuneration must be reported immediately to the responsible health authority in accordance with Section 4 PflBG. The employment of relevant persons for this purpose must also be notified.
If you provide or offer activities reserved for remuneration within the meaning of Section 4 of the Nursing Professions Act (PflBG), you must notify the public health department immediately, stating the name and address and, if applicable, the name and address of the facility.
If you provide or offer such an activity and employ appropriate persons for this purpose, you must also notify the public health department immediately, stating the name, address and professional training of the persons employed, naming the senior nursing staff and submitting the documents specified under Art. 16 Para. 1 Sentence 2 of the Health Services Act (GDG) for each of these persons without delay.
The health authority must also be notified immediately of any changes or discontinuation of notifiable facts.
However, the above does not apply to reserved activities carried out in care facilities licensed in accordance with Section 72 (1) sentence 1 of the Eleventh Book of the German Social Code, in hospitals within the meaning of Section 2 no. 1 of the Hospital Financing Act, maternity homes and facilities within the meaning of § 30 of the Industrial Code, medical rehabilitation facilities, spas and health resorts or in facilities to which the Nursing Home Act applies, as well as in the context of an employment relationship with or for the benefit of the person being cared for or as a courtesy or for reasons of family, kinship or neighborly assistance.
The notification and the required documents must be submitted to the locally competent health authority.
The health authority in whose district the natural person has their main residence or provides or offers the activities is locally responsible if the main residence is not in the Free State of Bavaria. In the case of other providers of care services, the health authority in whose district they have their registered office or provide or offer the activities is responsible if the care services have neither their registered office nor a branch in the Free State of Bavaria.
In the case of care services with organizationally independent local branches, the notification must also be made to the health authority in whose district the branch is located.
The authority can issue a confirmation of the notification on request.
The start, changes and termination of the activity must be reported immediately.
If you practise a legally regulated non-physician medical profession on a self-employed or freelance basis, you are obliged to report this to the responsible health authority.
