Procedure details

The authorized district chimney sweep can apply for the appointment of a suitable member of his/her company as a representative for the fireplace inspection. Suitability is checked by the appointing authority on the basis of the application documents submitted.

The company employees who are to be appointed as representatives for the fireplace inspection must:

  • be personally and professionally suitable for the job,
  • fulfill the legal requirements for the independent practice of the chimney sweep trade (§ 11b para. 1 and para. 3 SchfHwG)
  • have the legal knowledge required to perform the tasks involved in carrying out the fireplace inspection
  • be in good health and
  • have a good command of the German language

  • The following documents must be submitted together with the application:
    • Application by the district chimney sweep for the appointment of a company representative in accordance with § 11b SchfHwG (see "Forms" Application or use the "Online procedure")
    • Hand-signed consent of the company employee to take over the representation with a declaration of personal requirements (see "Forms" Declaration)
    • Current employment contract of the company employee and, if applicable, additional agreement to take on deputy tasks (non-relevant personal data should be blacked out)
    • Certificate of the master craftsman's examination or equivalent qualifications of the company employee; in the case of a professional qualification acquired in another member state of the European Union or a signatory state to the Agreement on the European Economic Area or Switzerland, the documents and certificates to be submitted in accordance with Section 6 of the Regulation on the requirements for nationals of a member state of the European Union or another signatory state to the Agreement on the European Economic Area or Switzerland for the exercise of a craft requiring a license (EU/EEA Crafts Regulation - EU/EWRHwV)
    • Simple police clearance certificate of the company employee(s) or police clearance certificate for submission to an authority
    • Professional background in the chimney sweeping trade of the company employee (without supporting documents)

The application must be submitted by the authorized district chimney sweep in writing or electronically (see "Forms" or "Online procedure").

The appointing authority checks the requirements on the basis of the application documents submitted.

If the requirements are met as a company representative, the authority will issue a notification for a fee approving the appointment. The applicant authorized district chimney sweep and the company representative each receive a copy of the decision.

The appointment and any time limit must be made public by the authority.

The fee for the application procedure is EUR 150. The costs must be borne by the authorized district chimney sweeps as applicants.

It should be noted that only a single employee directly associated with the business of an authorized district chimney sweep can be appointed as a representative for the fireplace inspection.

If the employee has concluded employment contracts with several authorized district chimney sweeps, the appointment as a representative belonging to the company can only be made for one of them in accordance with § 8 Para. 1 SchfHwG.

In the case of a fixed-term employment contract, the appointment must be limited to the end of the employment relationship. Unless a shorter period is specified, the appointment ends at the latest when the appointment of the authorized district chimney sweep ends or is terminated. If the employment contract is terminated before the end of the appointment period, the appointment of the representative must be terminated.

The authorized district chimney sweep must inform the authority immediately of any premature termination of the employment contract.
