For the guest pupils defined in Art. 10 Para. 1 of the Bavarian School Financing Act (BaySchFG), the school expenditure provider can demand a financial contribution to the costs of the school expenditure in accordance with the provisions of Art. 10 and 19 of the Bavarian School Financing Act (BaySchFG). This can take the form of a guest school contribution.

The Free State of Bavaria will contribute to the costs in cases where the pupils in question have their habitual residence outside Bavaria or have one of the legal foreigner statuses listed in Art. 35 para. 1 sentence 1 no. 1 - 4 of the Bavarian Education and Teaching Act (BayEUG).

Beneficiaries

Eligible applicants are school expenditure providers of state and municipal elementary school, secondary schools, intermediate schools, evening secondary schools, grammar schools - including colleges -, evening grammar schools and general education support centers.

Amount

The calculation (peak billing) of guest school fees for special needs centers and special schools is based on the provisions of Art. 10 Para. 2 BaySchFG and § 7 of the Implementing Regulation of the School Financing Act (AVBaySchFG) in conjunction with Annex 1 to the AVBaySchFG.

For the other relevant school types, Art. 10 Para. 3 BaySchFG stipulates flat rates for guest school fees, which replace the above-mentioned calculation of the guest school fee.

The flat rates are updated every two years.

For municipal secondary schools, evening secondary schools, grammar schools - including colleges - and evening grammar schools, the school authorities can also demand the guest school contribution lump sum of €800 in accordance with Art. 19 Para. 2 BaySchFG.

Only the circumstances as of October 1 of the year preceding the financial year (accounting year) are decisive

In the case of guest school fees for pupils from outside Bavaria, the pupil's usual place of residence must be outside Bavaria on the above-mentioned reference date.

In the case of guest school fees for foreign pupils, one of the following statuses under immigration law is required on the above-mentioned reference date:
Residence permit pursuant to § 55 para. 1 sentence 1 Asylum Act (AsylG), residence permit pursuant to §§ 23 para. 1, 24, 25 para. 4 sentence 1, para. 5 Residence Act (AufenthG), tolerated stay pursuant to § 60a Residence Act (AufenthG) or enforceable obligation to leave the country

Applications must be submitted in writing to the Bavarian State Office for Schools in the form of a completed application form with the required information, signed by the responsible authority.

In the case of applications for foreign pupils, the immigration status of the individual pupils must be indicated in the list on the application form by the responsible immigration authority. The application must be signed by the responsible authority and the foreigners authority(ies) processing the application.

Applications must be submitted by August 1 of the current financial year (lump sums) or for the previous financial year (top payments) at the latest. (see announcements of the Bavarian State Ministry for Education and Culture dated 03.04.1995 and 27.06.2003).

The guest school fees for applications received before June 15th will be paid on July 1st and for all other applications received by August 1st at the end of October each year.
