Differentiation staff support pupils as staff of the special school by offering special lessons. They are part of the other school staff in accordance with Art. 60a of the Bavarian Education and Teaching Act (BayEUG). They support the promotion of pupils with special educational needs at special schools, but do not take responsibility for their own promotion. They are deployed on a group basis to relieve teaching and educational situations, e.g. by providing support in self-care learning areas (school preparation facility (SVE)/diagnosis and support classes (DFK)/primary school level) and by taking on guided differentiation phases in small groups.
The head teachers of the special schools can apply for the employment of differentiation staff within the framework of the budget funds made available.
The application documents should be submitted to the government well in advance of the intended start of employment so that the contract can be issued and the remuneration paid in good time.
Upon submission of complete recruitment documents, contracts will be drawn up as quickly as possible.
Interested teachers can either apply to the government responsible for special schools in the region or directly to a special school as a differentiation worker.
The differentiation worker can only start work after approval by the government and after submitting an extended certificate of good conduct and proof of sufficient measles vaccination (for those born after 1970). Differentiation workers who are employed on a fixed-term basis must also sign a legally valid fixed-term agreement before commencing their employment.

Appeals against judgments of the labor court are lodged with the regional labor courts. An appeal can only be lodged if the value of the subject matter of the appeal exceeds EUR 600.00 or if it concerns a dispute over the status quo (e.g. dismissal) or if the appeal has been permitted in the judgment of the labor court. The appeal must always be allowed if the case is of fundamental importance or if the case concerns legal disputes between parties to collective agreements arising from collective agreements or concerning the existence or non-existence of collective agreements. The time limit for appeal is one month, the time limit for the statement of grounds for appeal is two months from the date of service of the judgment of the first instance in full form, but no later than five months after delivery. In certain cases, an appeal may be lodged against a judgment of the labor court to the Federal Labor Court (i.e. without prior appeal proceedings).
An appeal on points of law can be lodged with the Federal Labor Court against the judgment of a regional labor court if it has been granted by the regional labor court or by the Federal Labor Court in response to a complaint against denial of leave to appeal. The time limit for the appeal is one month, the time limit for the statement of grounds is two months.

The governments are responsible for the recruitment of teachers at primary and secondary schools, special schools, schools for the sick and vocational schools (excluding technical colleges and vocational colleges).
