Description
Alternative schools may be established and operated only with state approval. The application, along with all required documents, must be submitted to the school supervisory authority no later than four months before the start of the school year.
After the school supervisory authority has granted approval, changes may arise during the course of the school year that also require express approval from the government. The following changes, in particular, are considered to require approval:
- General changes: name changes, determination of general eligibility after the waiting period has expired, change in school leadership
- Changes in school organization: change of sponsoring body, establishment of open and mandatory full-day programs, relocation, expansion of class sizes, relocation of classes during renovations, establishment of additional grade levels
- Changes in internal operations: changes to the educational concept, deviations from the vacation schedule
Requirements
The permit shall be granted if
- the person who intends to establish, operate, or manage an alternative school provides assurance that he or she will not violate the constitutional order,
- the alternative school does not fall short of public schools in terms of its educational objectives and facilities, as well as in the academic or artistic training of its teachers
- the segregation of students based on their parents’ financial status is not encouraged
- the economic and legal status of the teachers is sufficiently safeguarded.
Proceedings
An application for approval by the school supervisory authority and for approval of a substantial change must be submitted to the competent government agency.
