Packaging disposal; application for confirmation of sufficient professional qualification of experts established abroad

Experts for packaging disposal established in other EU/EEA countries who only wish to carry out expert activities in Germany temporarily and occasionally can apply for confirmation of sufficient professional qualification.

This form can be submitted electronically (e.g. via a secure contact form using your user account with login via the electronic ID function or the ELSTER certificate) or handwritten and signed in paper form to the responsible authority.

In order to guarantee their obligation to take back and recycle such packaging, manufacturers of packaging subject to system participation do not need to participate in an officially established take-back system under certain conditions if they first provide evidence, in the form of an expert certificate, that a suitable sector-specific collection structure has been set up at all the collection points supplied and that the sales packaging collected in these structures will be recycled in the future in accordance with the Verpackungsgesetz (sector solution).

In addition, manufacturers of packaging subject to system participation generally have to submit annual declarations of completeness for the sales and secondary packaging placed on the market for the first time in the previous calendar year. Alternatively (instead of a tax consultant, for example), they can also have them checked and certified by an expert within the meaning of the Packaging Act.

Furthermore, (take-back) systems must document the recycling of the collected packaging on a calendar year basis (proof of volume flow). The proof of volume flow must be checked and confirmed by a registered expert.

These obligations are fulfilled if only the experts listed by the Central Agency in the register of inspectors are commissioned with the inspection and certification. These experts include, on the one hand, experts who have been publicly appointed for packaging disposal in accordance with Section 36 of the German Industrial Code. However, such experts also include experts established in other EU/EEA countries who only wish to carry out the expert activities provided for in the Packaging Act in Germany on a temporary and occasional basis if their sufficient professional qualification for this has been verified and confirmed by the public body responsible for the public appointment of such experts.

The review procedure examines whether the above-mentioned expert has the professional qualification required for a publicly appointed expert for packaging disposal.

Proof of legal establishment for the exercise of the activity of an expert for packaging disposal in an EU or EEA state, furthermore proof that this activity has not been prohibited, not even temporarily.

The applicant does not have to observe any deadlines when submitting the application for review. The review of the professional qualification must have taken place before commencing work in Germany.
