Purpose

As part of municipal financial equalization, the Free State of Bavaria supports its municipalities with construction measures on public school buildings, including school sports facilities (sports halls, outdoor sports facilities, indoor swimming pools) with grants in accordance with Art. 10 of the Bavarian Financial Equalization Act (BayFAG).

Eligible measures

  • New buildings, conversions and extensions
  • Acquisition including conversion or repair of a building
  • General and partial renovations

Measures for ongoing maintenance (maintenance costs) and the costs of ongoing operation are not eligible for funding.

Recipients of grants

Recipients of state allocations in accordance with Art. 10 BayFAG are exclusively municipalities, administrative districts, districts, administrative communities, school associations and municipal special-purpose associations, but not independent municipal companies under public law or municipal companies in the legal forms of private law.

If a project is carried out by another project sponsor and the local authority contributes to the construction or acquisition costs with a grant, the local authority will be granted allocations in accordance with Art. 10 BayFAG.

Eligible expenditure

The basis for the state subsidy is not the total costs, but the eligible expenditure. Eligible expenditure is determined in accordance with No. 5.2 of the Allocation Guidelines (FAZR).

Type and amount

The allocations are granted as project funding by way of pro rata financing.

  • The funding framework is generally 0 to 80 %, and the financial situation of the municipality, taking into account demographic developments, the importance of the construction project, a catchment area that extends beyond the territory of the municipality, the state interest and the amount of available funds are taken into account when determining the amount of the allocation.
  • The funding rate orientation value for municipalities whose financial situation corresponds to the national average for comparable municipalities is 50%.
  • Municipal building investments for the first-time expansion of all-day facilities approved by the school authorities receive an additional 15 percentage points on top of the regular funding rate ("FAGplus15").

  • Funding is based on the space requirements determined by the school authorities. This is determined for new buildings, conversions and extensions as well as for the acquisition of buildings in the school supervisory approval to be applied for from the government.
  • The overall financing must be secured. The local authority must be in a position to raise the necessary own funds and also to finance the expected follow-up costs in the future.
  • As a rule, the planning documents must be professionally reviewed before the start of a construction project.
  • Allocations in accordance with Art. 10 BayFAG may only be granted for measures that have not yet been started.
  • Measures can only be funded if their eligible expenditure exceeds the de minimis limit of €100,000.
  • Damage caused by natural hazards and measures to implement barrier-free accessibility are eligible for funding if their allocable expenditure is at least €25,000.
  • A de minimis limit of €50,000 applies to construction measures for the expansion of all-day school facilities ("FAGplus15").
  • The subsidized property must generally be used for at least 25 years in accordance with the purpose of the allocation. Deviating from this, the construction of temporary buildings is eligible for funding if their use is secured for at least ten years and the need for this has been established.
  • If the period of use is shorter, a pro rata amount must be reimbursed unless the project is used for other eligible municipal purposes or to fulfill other municipal tasks of the allocation recipient and no income is generated from this.
  • If, in addition to the funding in accordance with Art. 10 BayFAG, other grants are also awarded for the same eligible expenditure for a project, it must be taken into account when determining the funding rate that the grant recipient retains an own contribution of at least 10% of the eligible expenditure.

    If the objection has no suspensive effect, an application for suspension of enforcement can be made to the original authority or the objection authority in accordance with Section 80 (4) VwGO. Instead, an application for an order or restoration of the suspensive effect of the objection can be made to the competent Bavarian Administrative Court in accordance with Section 80 (5) VwGO.

    Please note: If it concerns the demand for public charges and costs (§ 80 Para. 2 Sentence 1 No. 1 VwGO), an application to the court is generally only admissible if the authority has previously rejected an application for suspension of enforcement (§ 80 Para. 6 VwGO).
