Procedure details

Purpose and object

Educational support is provided for studies in accordance with the provisions of the Federal Training Assistance Act (BAföG).

Educational support is only granted if the student, their spouse and their parents are unable to cover the necessary costs of education and living expenses on the basis of their own income and assets. In certain cases (e.g. long-term employment), support is granted without taking parental income into account.

Beneficiaries

Participants in full-time training courses are generally eligible to apply. Further criteria can be found under "Requirements".

Type and amount

The maximum funding rate for educational support depends on the type of accommodation. As a rule, half of the funding is provided as a grant and half as an interest-free government loan.

The maximum monthly funding rate for attending higher technical colleges, academies and universities is EUR 511 (EUR 812 if trainees no longer live with their parents).

If trainees themselves are subject to health and nursing care insurance contributions, the amount required is increased by 122 euros per month.

Responsible office

For students studying at universities in Bavaria, the offices for educational support belonging to the Studierendenwerk of the respective university are responsible. The contact details of the responsible Studierendenwerk are displayed when you select the location of the university in the BayernPortal under "My location".

Funding is provided for attendance at public universities. In the case of non-state universities, educational support is only granted if the Bavarian State Ministry of Education and Cultural Affairs, Science and the Arts recognizes the equivalence of attending this institution with attending a public or state-approved university. Educational support is only granted for the time during which the training fully occupies the trainee's working capacity (full-time training).

Training assistance is generally only provided for initial training, but under certain circumstances it is also possible to receive assistance for further training.

The following are generally eligible

  • Germans,
  • recognized persons entitled to asylum and refugees and
  • other foreigners under certain conditions, in particular nationals of EC member states.

Training assistance is generally no longer paid if the trainee has reached the age of 45 at the start of the training period for which they are applying for training assistance. Trainees who have reached the age of 45 during a previously completed Bachelor's or Bachelor's degree course can then immediately begin a course of study (Master's course) eligible for funding in accordance with § 7 Paragraph 1a.

  • The documents required depend on the type of grant and can be found in the relevant forms.

The application must be submitted in writing or electronically (see "Online procedure") to the responsible Office for Educational Support. The contact details of the responsible Studierendenwerk are displayed when you select the location of the university under "My location".

If the applicant has not yet submitted all the necessary documents for the decision on the application, the Office for Educational Support will contact the applicant and ask for the missing documents to be submitted. Other authorities will not be involved.

None

Educational support is only paid from the beginning of the month in which the course is started, i.e. from the month in which the lectures actually begin, but at the earliest from the month in which the application is received in writing or electronically (see "Online procedure") by the responsible office for educational support. Education grants are not paid retroactively.

A new application is required for each approval period (usually one academic year).

In the case of subsequent applications, the application must be submitted in full at least two months before the end of the old approval period in order to avoid interruptions in payment.

The processing time or the total processing time between the application being submitted and the approval notice being issued can be expected to be around 6 to 8 weeks.

Certain funding offices are responsible for funding education abroad. Each of the eighteen offices abroad is responsible for a specific foreign country or several foreign countries. The list of offices attached to the explanatory notes to Form 6 (see "Forms") shows which office is responsible for funding the respective education abroad.

(Optional) opposition procedure: Choice between filing an objection and bringing an action directly

  • Appeal procedure (optional); lodging an appeal

If the objection has no suspensive effect, an application for suspension of enforcement can be made to the original authority or the objection authority in accordance with Section 80 (4) VwGO. Instead, an application for an order or restoration of the suspensive effect of the objection can be made to the competent Bavarian Administrative Court in accordance with Section 80 (5) VwGO.

Please note: If it concerns the demand for public charges and costs (§ 80 Para. 2 Sentence 1 No. 1 VwGO), an application to the court is generally only admissible if the authority has previously rejected an application for suspension of enforcement (§ 80 Para. 6 VwGO).
