Procedure details

Purpose

As part of the municipal financial equalization scheme, the Free State of Bavaria supports its municipalities with grants for construction work on child daycare facilities in accordance with Art. 10 of the Bavarian Financial Equalization Act (BayFAG).

Object

Eligible facilities are

  • Crèches
  • kindergartens
  • day nurseries
  • mixed-age facilities

Eligible measures:

  • New buildings, conversions and extensions
  • Acquisition including conversion or renovation of a building
  • General and partial renovations

Recipients of grants

Recipients of state grants under Art. 10 BayFAG are exclusively municipalities, rural districts, districts, administrative communities, school associations and municipal special-purpose associations, but not independent municipal companies under public law or municipal companies in the legal forms of private law. If a project is carried out by another project sponsor and the municipality participates in this with a grant towards the construction or acquisition costs, the municipality will be granted grants for this under Art. 10 BayFAG.

Eligible costs

The basis for state funding is not the total costs, but the eligible expenditure. The eligible expenditure is determined in accordance with No. 5.2 of the Allocation Guidelines (FAZR).

Type and amount

The funding is granted in the form of pro rata financing/capital participation.

The type of funding is project funding.
The funding period covers the entire duration of the project.

The allocations are granted as project funding by way of pro rata financing with a certain percentage of the eligible expenditure.

  • The funding framework is generally 0 to 80 %.
  • When determining the amount of the allocation, particular consideration is given to the financial situation of the local authority, taking into account demographic trends, the importance of the construction project, a catchment area that extends beyond the territory of the local authority, the national interest and the amount of funds available.
  • For municipalities whose financial situation corresponds to the national average of comparable municipalities, a funding rate orientation value of 50% can be assumed.

  • Funding requires that the daycare center is eligible for funding in accordance with Art. 19 BayKiBiG. It is limited to the local needs recognized by the municipality in accordance with Art. 7 BayKiBiG.
  • Overall funding must be secured. The local authority must be in a position to raise the necessary own funds and also to finance the expected follow-up costs in the future.
  • As a rule, the planning documents must be professionally reviewed before the start of a construction project.
  • Allocations in accordance with Art. 10 BayFAG may only be granted for measures that have not yet been started.
  • Measures can only be funded if their eligible expenditure exceeds the de minimis limit of €100,000.
  • Damage caused by natural hazards and measures to implement accessibility are eligible for funding if their allocable expenditure is at least €25,000.
  • The subsidized property must generally be used for at least 25 years in accordance with the purpose of the allocation. Deviating from this, the construction of temporary buildings is eligible for funding if their use is secured for at least ten years and the need for this has been established.
  • If the period of use is shorter, a pro rata amount must be reimbursed unless the project is used for other eligible municipal purposes or to fulfill other municipal tasks of the allocation recipient and no income is generated from this.
  • If, in addition to the funding pursuant to Art. 10 BayFAG, other grants are also awarded for the same eligible expenditure for a project, it must be taken into account when determining the funding rate that the grant recipient retains an own contribution of at least 10% of the eligible expenditure.

Exclusion criteria:

The following are not eligible for funding under Art. 10 BayFAG:

  • Measures for ongoing maintenance (maintenance expenditure) and costs of ongoing operation.
  • Small construction measures with allocable expenditure of less than € 100,000.
  • Construction measures that have already been started or completed.

Applications for allocations must be submitted to the district government responsible for the municipality. The templates provided by the granting authority must be used for this purpose.

Further procedure:

  • The government examines and decides on the application.
  • Allocations are approved by the government for one financial year at a time.
  • After completion of the measure, proof of the appropriate use of the allocation must be submitted.

(The construction project may only be started after a corresponding approval notice has been issued or after prior approval for the early start of the project).

There are no costs.

There are no fixed deadlines for this funding.

Construction work may only commence after a corresponding approval notice has been issued or after prior approval for early commencement of the measure.

You have one month to appeal against the allocation decision. You will be informed of the office to which you can submit the appeal in the notification.

  • Appeal procedure (optional); lodging an appeal

    If the objection has no suspensive effect, an application for suspension of enforcement can be made to the original authority or the objection authority in accordance with Section 80 (4) VwGO. Instead, an application for an order or restoration of the suspensive effect of the objection can be made to the competent Bavarian Administrative Court in accordance with Section 80 (5) VwGO.

    Please note: If it concerns the demand for public charges and costs (§ 80 Para. 2 Sentence 1 No. 1 VwGO), an application to the court is generally only admissible if the authority has previously rejected an application for suspension of enforcement (§ 80 Para. 6 VwGO).
