Purpose

As part of the municipal financial equalization scheme, the Free State of Bavaria supports its municipalities with grants for construction work on day-care facilities for children in accordance with Art. 10 of the Bavarian Financial Equalization Act (BayFAG).

Object

Eligible facilities are

  • Crèches
  • kindergartens
  • day nurseries
  • Mixed-age facilities

Eligible measures within the scope of Art. 10 BayFAG are

  • New buildings, conversions and extensions
  • Acquisition including conversion of a building
  • General and partial renovations

Eligible costs

The basis for state funding is not the total costs, but the eligible expenditure. Eligible expenditure is determined in accordance with No. 5.2 of the Allocation Guidelines (FAZR).

Type and amount

The funding is granted in the form of pro rata financing/capital participation.
The type of funding is project funding.

  • The allocations are granted as proportional financing with a certain percentage of the eligible expenditure.
  • The funding range is generally 0 to 80 %.
  • When determining the amount of the allocation, particular consideration is given to the financial situation of the local authority, taking into account demographic trends, the importance of the construction project, a catchment area that extends beyond the territory of the local authority, the national interest and the amount of funds available.
  • For municipalities whose financial situation corresponds to the state average of comparable municipalities, a funding rate orientation value of 50% can be assumed.

Financial capacity and economic viability of the measure:

  • The local authority must be in a position to raise the necessary own funds and also to finance the expected follow-up costs in the future.
  • State grants are only awarded if the measure is planned economically.

Technical approval:

  • Funding requires that the child day care facility must be eligible for funding in accordance with Art. 19 BayKiBiG and is limited to the local area recognized by the municipality in accordance with Art. 7 BayKiBiG.
  • As a rule, the planning documents must be professionally checked before the start of a construction project.

Exceeding the de minimis limit:

  • Measures can only be funded if their finally determined allocable expenditure exceeds the de minimis limit of EUR 100,000.
  • Damage caused by natural hazards and measures to implement accessibility are eligible for funding if their allocable expenditure amounts to at least EUR 25,000.

Prior approval of the approval authority for the start of the measure:

  • Allocations in accordance with Art. 10 BayFAG may only be granted for measures that have not yet been started.
  • Prior to the start of the construction measure, a corresponding approval notice or prior approval for the early start of the measure by the approval authority is mandatory.

Earmarking period:

  • The subsidized building must be used for at least 25 years in accordance with the purpose for which it was allocated.
  • If the period of use is shorter, a pro rata amount must be reimbursed unless the project is used for other eligible municipal purposes or to fulfill other municipal tasks of the grant recipient and no corresponding income is generated.
  • Deviating from this, the construction of temporary buildings is eligible for funding if the use is secured for at least ten years and the need for this has been established.

Recipients of state allocations pursuant to Art. 10 BayFAG are exclusively municipalities, administrative districts, districts, administrative communities, school associations and municipal special-purpose associations, but not independent municipal companies under public law or municipal companies in the legal forms of private law. If a project is carried out by another project sponsor (e.g. construction of a child daycare facility by a church sponsor) and the municipality contributes to the construction or acquisition costs with a grant, the municipality will be granted allocations in accordance with Art. 10 BayFAG.


Exclusion criteria:

The following are not eligible for funding under Art. 10 BayFAG:

  • Measures of ongoing maintenance (maintenance costs) and costs of ongoing operation.
  • Small construction measures with allocable expenditure of less than € 100,000.
  • Construction measures that have already been started or completed.

    • Im Fall der Vermietung des nach Art. 10 BayFAG geförderten Gebäudes: Mietberechnung sowie eine Bestätigung, wonach das Mietentgelt keine durch die staatlichen Zuweisungen gedeckten Investitionskostenanteile enthält

  • Appeal procedure (optional); lodging an appeal

    If the objection has no suspensive effect, an application for suspension of enforcement can be made to the original authority or the objection authority in accordance with Section 80 (4) VwGO. Instead, an application for an order or restoration of the suspensive effect of the objection can be made to the competent Bavarian Administrative Court in accordance with Section 80 (5) VwGO.

    Please note: If it concerns the demand for public charges and costs (§ 80 Para. 2 Sentence 1 No. 1 VwGO), an application to the court is generally only admissible if the authority has previously rejected an application for suspension of enforcement (§ 80 Para. 6 VwGO).
